1.Who can use KoalaDish
KoalaDish is a professional tool for restaurants, bars, cafés and other hospitality businesses. You must be at least 18 years old and authorised to act for the business you register. Because the service is provided to businesses and professionals, the consumer right of withdrawal does not apply.
2.The service
KoalaDish lets you create a restaurant website and digital menu, generate a QR code and publish your site at a koaladish.com address or, on the Premium plan, on your own domain. Depending on your plan, it also includes features such as online reservations, WhatsApp contact, events and Happy Hour.
The features and limits of each plan are those described on our Pricing page when you choose the plan. We keep improving KoalaDish and may change features, but we will not materially reduce the features of a plan you have already paid for during the current billing period.
3.Your account
Give us accurate information and keep your password secure. You are responsible for everything done through your account. Tell us straight away if you think someone else has accessed it.
4.Plans, prices and payment
- The Free plan costs nothing and has the limits shown on the Pricing page.
- Standard and Premium are paid monthly or yearly. Prices are in euros and exclude VAT; the applicable VAT is added at checkout and shown on your invoice.
- Payments are processed by Stripe. We never see or store your full card details.
- Subscriptions renew automatically at the end of each billing period until you cancel.
- Upgrades apply immediately, and the price difference for the rest of the current period is charged straight away.
- Downgrades apply from your next renewal date.
- If you cancel, your plan stays active until the end of the period you have paid for and then returns to Free. Partial periods are not refunded, except where the law requires it.
- If a payment fails, we may limit paid features until it is resolved.
- If we change our prices, we will tell you at least 30 days before the new price applies to your next renewal, so you can cancel first if you wish.
5.When a plan changes or ends
Features that are not included in your new plan stop being available. We do not delete your restaurant content because of a plan change, but you may need to adjust it (for example, the number of menu items or the template) to fit the new plan's limits.
6.Your content
You keep all rights to the content you upload: texts, menus, prices, logos and photos. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy and display that content only as needed to provide the service, including showing your public website.
You confirm that you have the right to use everything you publish, and that your menus, prices, allergen information (EU Regulation 1169/2011), opening hours and other details are accurate and kept up to date.
7.Acceptable use
You must not use KoalaDish to publish unlawful, misleading or infringing content; to send spam or malicious code; to try to get around plan limits or security measures; to collect data from other users' sites; or to resell the service without our written permission.
8.Reservations and guest data
Reservations and event bookings made through your website are an agreement between you and your guests. You decide whether to accept them and you manage them.
For the personal data of your guests, you are the data controller and we are your data processor under Article 28 of the GDPR. As your processor we:
- process guest data only to provide the service, following the instructions you give by using it;
- make sure that anyone with access to the data is bound by confidentiality;
- apply appropriate technical and organisational security measures;
- use the sub-processors listed in our Privacy Policy, which you authorise generally, and tell you about any changes so you can object;
- help you answer your guests' requests to exercise their rights;
- tell you without undue delay if we become aware of a personal data breach affecting your guests;
- delete or return the data when the service ends, unless the law requires us to keep it;
- give you the information needed to show compliance with these obligations.
You are responsible for having a lawful basis to process your guests' data and for giving them the information the law requires.
9.Custom domains
To use your own domain (Premium), you must own it and be able to change its DNS settings. We are not responsible for problems caused by your domain registrar or DNS provider.
10.Availability and support
We aim to keep KoalaDish running reliably but cannot promise uninterrupted service. There may be maintenance or problems outside our control. For help, write to support@koaladish.com.
11.Ending the agreement
You can stop using KoalaDish at any time. To close your account and delete its data, write to support@koaladish.com.
We may suspend or close an account for a serious or repeated breach of these terms, for non-payment or when the law requires it. Where possible we will warn you first and give you time to fix the problem.
When an account is closed, we delete its data within a reasonable time, except what the law requires us to keep, such as invoices.
12.Liability
As far as the law allows, we are not liable for indirect losses such as lost profits, lost bookings or loss of reputation. Our total liability to you is limited to the amount you paid us in the 12 months before the event that caused the claim. Nothing in these terms limits liability for wilful misconduct, gross negligence or anything else that cannot be limited by law.
13.Changes to these terms
If we make significant changes, we will tell you by email or in your dashboard at least 15 days before they apply. If you do not agree, you can cancel before then. Continuing to use the service afterwards means you accept the new terms.
14.Applicable law
These terms are governed by Spanish law. Any dispute will be handled by the courts of Valencia (Spain).
